Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Neary mobile application (the “App”). By using Neary, you agree to these Terms. If you do not agree, do not use the App.
1. The service
Neary helps people discover others nearby at landmarks, send handshake requests, chat in landmark rooms, and optionally exchange contact information after both people accept a handshake.
2. Eligibility
You must be at least 13 years old (or the minimum legal age in your country) to use Neary. If you use Neary on behalf of someone else, you confirm you have authority to accept these Terms.
3. Accounts
- You may use Neary as a guest (anonymous account) or sign in with Google.
- You are responsible for activity under your account.
- Provide accurate profile information and keep it updated.
- You may delete your account from Profile settings where available.
4. Acceptable use
You agree not to:
- Harass, threaten, stalk, or harm other users
- Share illegal, hateful, sexual content involving minors, or otherwise abusive content
- Impersonate others or misrepresent your identity in a deceptive way
- Use the App to spam, scrape, or reverse engineer systems
- Interfere with landmark presence, chat, or handshake features
- Use the App in a way that violates local law or another person’s rights
Neary is for real-world social discovery. Be respectful in person and in the App. Consent matters for handshakes and contact sharing.
5. Location and visibility
The App needs location access to place you in landmarks and show nearby people. You control profile visibility in the App. When visible, other authenticated users at the same landmark may see your name and photo.
6. Handshakes and phone numbers
- Handshake requests may include a short intro message.
- Phone numbers are shared only after both sides accept a handshake.
- You are responsible for the phone number you add and how you use numbers you receive.
- Do not use shared contact details for spam or harassment.
7. Chat
Landmark chat is visible to users in that landmark context. Do not post private information you are not comfortable sharing publicly in that room. We may remove content or restrict accounts that violate these Terms.
8. Ads
The App may show advertisements (including Google AdMob). Ads help keep Neary available. Ad content is provided by third parties and is not an endorsement by Neary.
9. Intellectual property
The App, branding, and related materials are owned by Neary or its licensors. You may not copy, modify, or distribute the App except as allowed by law or with our written permission. You keep rights to content you submit, and grant us a limited license to host and display it to operate the service.
10. Safety disclaimer
Meeting people in real life involves risk. Use common sense. Neary does not conduct background checks and does not guarantee the identity, intentions, or conduct of users. You use the App and meet others at your own risk.
11. Service availability
We may change, suspend, or discontinue features at any time. The App may be unavailable due to maintenance, network issues, or third-party outages (including Firebase, maps/location, or ads).
12. Termination
You may stop using Neary at any time and may delete your account in the App. We may suspend or terminate access if you violate these Terms or if needed to protect the service or other users.
13. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEARY AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
15. Privacy
Our Privacy Policy explains how we collect and use information. By using Neary, you also acknowledge that policy.
16. Changes to these Terms
We may update these Terms. Continued use of the App after changes means you accept the updated Terms. The “Last updated” date shows the latest revision.
